This Acceptable Use Policy sets out how the products, services and websites of MIDDAG, LLC, a limited liability company registered in Delaware, United States, may and may not be used.

This policy is part of the Terms of Service and applies to every customer and to every user who accesses the products, services and websites through a customer’s account.

A customer is responsible for the use that its users make of the products and services, and ensures that they follow this policy.

A product or service may have additional usage rules in the Service Terms; those rules add to this policy.

General rules

The products and services may be used only for their intended purposes, as described in their documentation, and in compliance with applicable law.

The products and services may not be used in a way that infringes the rights of others.

If a customer is unsure whether its business or activity is allowed under this policy, it should contact [email protected] before buying or using the products and services.

Prohibited businesses and activities

The products and services may not be used for, or by a business engaged in, any of the activities below; the list gives examples and is not exhaustive:

  • gambling of any kind, including online casinos, sports betting, lotteries and sweepstakes;
  • pornography or other adult or obscene content, including access to such content hosted elsewhere;
  • pyramid schemes, Ponzi schemes and any other financial fraud, including promises of quick or easy wealth;
  • any illegal, fraudulent or deceptive activity, including defamation and unlawful discrimination;
  • activities that cause harm to others, including hacking, spam, phishing and any other cyberattack;
  • content that infringes, or encourages the infringement of, the law or the rights of others, including copyright and other intellectual property rights.

This prohibition also covers content that promotes any of these activities, and the sale of technology meant for their operation.

Content

A customer is responsible for the content that it and its users upload, store, publish or transmit through the products and services.

Content may not be unlawful, violent, threatening, defamatory, obscene or discriminatory, and may not incite violence.

Content may not contain viruses, malware or any other harmful code, and a customer checks files for harmful code before uploading them.

Security of the products and services

No one may probe, scan or test the vulnerability of the products, services or websites, except as the Security page allows.

No one may breach or circumvent any authentication, access control, usage limit or other security measure of the products, services or websites.

No one may access, or try to access, an account, system or data that they are not authorized to access.

No one may interfere with, overload or disrupt the products, services or websites, or their use by others, including through denial-of-service attacks or load testing without prior written approval of MIDDAG, LLC.

Use of resources

The products and services, and each plan, have resource limits, such as bandwidth, storage, processing capacity and number of users, as described in their documentation or in the order.

A customer uses resources responsibly and within the limits of its plan.

Use above the limits of a plan may be charged as additional use, as described in the documentation or in the order, or may require a change to a higher plan.

Any use that consumes resources out of proportion to the plan, or that degrades the performance of the systems of MIDDAG, LLC for others, is prohibited.

Resale

A customer may not sell, resell, rent or lease the products and services, except as a reseller approved under the Partner Program.

Artificial intelligence

The use of artificial intelligence features, including those connected through a provider that the user chooses, is subject to this policy and to the AI Terms.

Enforcement

If MIDDAG, LLC reasonably believes that this policy has been violated, it may investigate, remove or disable access to the content involved, restrict the account, or suspend the products and services, in proportion to the seriousness of the violation and as set out in the Terms of Service.

MIDDAG, LLC may suspend the products and services immediately, without prior notice, when a violation puts at risk the security or integrity of the products and services, other customers or third parties, or when the law requires it.

When MIDDAG, LLC suspends without prior notice, it notifies the customer as soon as practicable, unless the law forbids it.

A serious or repeated violation may lead to the termination of the account under the Terms of Service.

A customer’s liability for a violation of this policy by it or its users follows the Terms of Service.
